  Naturalization: Denial to Approval

NOW a full-fledged American citizen, Pastor Bautista is working on the petition of his dear wife, Trinidad, with the help of Atty. James Beirne

PASTOR Bautista was a typical country boy in the Philippines. Born and raised under modest conditions in Morong, Rizal, Mang Pastor, as he is fondly called, did not get the chance to pursue his education. After finishing primary school, he decided to help his family make money for their daily subsistence.

Mang Pastor did well for himself, considering his circumstances. Later on when he had a family of his own, Mang Pastor managed to establish a duck farm and a sari-sari (mini) store that helped him send his three children to school.

One of them, Elvira Bautista-Concepcion, achieved what her father could only hope he did. She finished college, earning a B.S. degree in Chemistry and went on to make a good living here in the United States. As soon as Elvira settled in her new home country, she immediately filed a petition for her father, who finally set foot on American soil in June 1993.

After more than seven years of residency in the U.S., Mang Pastor decided to apply for naturalization with the INS. Everything turned out well except for the interview, which he failed because of his poor command of English. Unable to answer correctly at least seven questions, he also did not make it the second time.

“Nahirapan akong intindihin ang mga tanong dahil mabilis sila magsalita. Mababa lamang ang pinag-aralan ko kaya simple lamang ang alam kong Ingles (I could not understand the questions. The INS officer spoke too fast. My knowledge of English words and phrases is very limited),” explained Mang Pastor.

Frustrated and helpless, Mang Pastor and his daughter decided to seek the assistance of Atty. James Beirne of the Asian American Legal Center (AALC). After looking into the case, the lawyer decided to accompany Mang Pastor to his third interview along with a Filipino interpreter. Mang Pastor passed the interview with flying colors. At last, Mang Pastor is now a full-fledged American citizen.

Mang Pastor cannot wait to have his beloved wife, Trinidad, enjoy the benefits of becoming a naturalized citizen of the United States. He filed a petition for her with the help of the Law Offices of James G. Beirne and is confident that everything will go smooth and easy. “Lumapit muli kami kay Atty. Beirne upang mapadali ang proseso ng petisyon ko sa aking kabiyak (We are again seeking the help of Atty. Beirne to make the processing of my wife’s petition trouble-free),” Mang Pastor said.
